Consent to Personal Data Processing

1. What this document is

By registering with Clipia.ai and using the service you consent to the processing of your personal data on the terms set out below. We publish the full text here so you can read it before you give consent and return to it at any time.

Consent is not the only legal basis we rely on. Part of the processing is necessary to perform our contract with you, part is required by law, and part rests on our legitimate interest in keeping the service safe. The complete picture is in the Privacy Policy.

• creating, running and maintaining your account;
• providing the service: generating and editing images, video, audio and text from your requests, storing the works you create and giving you access to them;
• payments: subscriptions and credit packs, credit accounting, issuing and sending payment documents;
• customer support and answering your requests;
• content moderation, service security, fraud and abuse prevention;
• improving the service and analysing how it is used;
• sending informational messages — under the separate consent in section 8.

4. Categories of personal data

• email address and username;
• sign-in credentials, including identifiers of external accounts if you sign in through them;
• payment records: the fact, amount, status and identifier of a payment. We neither receive nor store card details — they are handled by the payment provider;
• the text prompts you send to models;
• images, video and audio you upload, generation results and their parameters;
• technical data: IP address (stored in hashed form), device and browser information, timestamps, usage statistics and cookie data (see the Cookie Policy).

On facial images. Images and videos you upload may contain depictions of faces. We process them solely to provide content generation and editing. We do not build a biometric identifier, faceprint or template from them and do not use them to identify or verify any individual.

5. Processing operations

Consent covers the following operations: collection, recording, organisation, accumulation, storage, adaptation or alteration, retrieval, use, transfer (disclosure and provision of access), anonymisation, blocking, erasure and destruction of personal data.

Processing is carried out both with and without automated means. Automated checks are used for content moderation and abuse prevention; if you believe such a check produced the wrong result, you can contest it at appeals@clipia.ai.

6. Where data is processed and who receives it

To run a generation, some data — primarily the text of your request and the files you upload — is passed to AI generation providers, which are located in several countries. Categories of data, destination countries, legal grounds, safeguards and retention periods at recipients are described in International Data Processing & Transfers. Withdrawing consent to those transfers makes generation impossible, because the service cannot be delivered without passing the request to a provider.

7. Images of other people

If you upload an image or video featuring another person, you confirm that you have obtained that person's consent to such use of their likeness. Responsibility for holding that consent rests with the user who uploaded the material.

The other person's consent should record:

• who the depicted person is and confirmation that they are of legal age;
• which Clipia.ai user is being granted permission;
• the scope of the permission — full or limited to specific types of material — and its duration: open-ended, until a stated date, or for a single project;
• confirmation that the person understands how AI generation works and is not bound by agreements that prohibit the use of their likeness.

Consent may be evidenced by a handwritten or electronic signature, a video confirmation, or an email sent from the depicted person's own address. Keep a copy for at least three years and be ready to produce it at our request.

Regardless of any consent given, it is prohibited to create sexual material featuring the depicted person, material intended to damage their reputation, material that misrepresents their actions or statements, or anything unlawful. The depicted person may withdraw their consent at any time by notifying the user; withdrawal does not affect the lawfulness of use before it.

If your likeness has been used without consent, write to abuse@clipia.ai — we review such reports under the Acceptable Use Policy.

8. Informational messages

Consent to receive informational emails is given by a separate confirmation at registration and does not affect your ability to use the service. You can withdraw it at any time through the "Unsubscribe" link in any such email or by writing to privacy@clipia.ai.

Withdrawal does not cover service emails — address confirmation, access recovery, payment notices and changes to the terms: those are part of performing the contract.

9. Duration and withdrawal

Consent applies from the moment it is given until the purposes of processing are achieved or until you withdraw it.

To withdraw, write to privacy@clipia.ai or dpo@clipia.ai, or delete your account. Once we receive a withdrawal we stop the processing and erase the data — except where the law allows or requires us to continue without consent: performing the contract, meeting accounting and tax obligations, and defending legal claims.

Retention periods per category are listed in the Privacy Policy: account data is kept until the account is deleted plus 30 days, moderation logs for 90 days (critical ones for 7 years), and payment records for the periods required by law.

10. Your rights

• obtain confirmation that we process your data and access a copy of it;
• have inaccurate or unlawfully obtained data corrected, blocked or erased;
• withdraw your consent in whole or in part;
• receive your data in a machine-readable format;
• lodge a complaint with the competent supervisory authority or a court.

11. Changes to this document

We update this text whenever the purposes, categories of data or recipients change. We notify you of material changes in the service interface or by email; the current version is always published on this page.
